1. Acceptance of Terms

By accessing or using the website of Rose City Instruments (“we,” “our,” or “us”), you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with any part of these terms, please do not use our website or services.

2. Use of Website

You agree to use this website only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use of the site.

3. Products & Services

Rose City Instruments offers:

• New and used instruments
• Consignment instruments
• Accessories and mouthpieces
• Repair and cleaning services

All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time.

4. Pricing & Payment

All prices are listed in U.S. Dollars and are subject to change without notice.

• Full payment is required before shipment or trial
• Payments are processed securely through third-party providers

We reserve the right to cancel or refuse any order.

5. Trial & Return Policy

By purchasing from Rose City Instruments, you agree to our posted Trial and Return Policy, including:

• 7-day trial period (where applicable)
• Restocking fees (5% instruments / 10% accessories)
• No returns on special orders
• Customer responsibility for return shipping and insurance
• Responsibility for any damage during trial or return

6. Shipping & Delivery

• Tubas are shipped via freight
• Other items are shipped via standard carriers (UPS, etc.)

Customers are responsible for:

• Shipping costs (unless otherwise stated)
• Additional freight charges (residential, schools, etc.)

Delivery times are estimates and not guaranteed.

Rose City Instruments is not responsible for delays caused by carriers.

7. Risk of Loss

All items become the responsibility of the customer upon delivery.

Customers are responsible for:

• Proper handling during trial periods
• Any damage during return shipping
• Insurance coverage for shipped items

8. Consignment Sales

Our consignments work as follows. Instruments will be listed for sale as soon as possible. The consignee retains 85% of the sale price minus any repairs or cleanings that may need to occur. Again, any repairs or cleaning costs will be deducted from the consignee's 85%, or can be paid additionally by the consignee. Payment to consignee will be made within 14 days of the sale. We reserve the right to accept or decline any instrument(s) for consignment. Please do not send us an instrument to consign without speaking with us first.

9. Repairs & Services

We are not responsible for:

• Pre-existing damage not disclosed
• Damage resulting from normal use after service
• Delays due to parts availability or workload

10. Intellectual Property

All content on this website—including text, images, logos, and branding—is the property of Rose City Instruments and may not be used without permission.

11. Limitation of Liability

To the fullest extent permitted by law, Rose City Instruments shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of use, revenue, or profits
• Damage resulting from misuse of products

12. Indemnification

You agree to indemnify and hold harmless Rose City Instruments from any claims, damages, or expenses arising from your use of the website or violation of these terms.
